Irving's New Noise Ordinance Could Be Preempted by Proposed State Law

A bill that would restrict Housing Finance Corporations created outside of Dallas County from purchasing property in Irving & removing that property from the property tax rolls will be heard in the House Intergovernmental Affairs Committee on March 25.

House Bill 2625 by Rep. Emilio DeAyala (R-District 133) would allow overnight deliveries for one hour or less between 10 p.m. and 5 a.m. as long as the volume doesn’t exceed 75 decibels when measured from the closest residential property. Irving's current noise ordinance prohibits the loading or unloading of any vehicle at a place of business adjacent to residential areas or at a residence between the hours of 9 p.m. and 7 a.m. Monday through Friday, and between 9 p.m. and 9 a.m. on Saturday and Sunday. It also limits the sound to 60 decibels.

A similar bill, SB 1358 by Senator Tan Parker (R-Flower Mound), has already had a public hearing and is pending in the Senate Business and Commerce Committee.
